A fggggggggggggggggggggggggg self-audit is designed by the employer to be appropriate to the scope of hazards it is aimed at discovering, and to fgggggggggggggggggggggggggggg an fgggggggggggggggggggggggggggggg basis for fgggggggggggggggggggggggggg action; (b.) ``Documented'' means that the findings of the self-audit are fgggggggggggggggggggggggggggggggggggg recorded and maintained by the employer; (c.) ``Objective'' means that the selfaudit is conducted by or under the direction of a safety and health fgggggggggggggggggggggggggg who is fgggggggggggggggggggggggggggggggggggg to fggggggggggggggggggggggggggggggggg workplace safety and health hazards, given the scope and complexity of the processes under fgggggggggggggggggggggggggggg. 2. ``Voluntary'' means that the selfaudit is not required by fgggggggggggggggggggggggggggggggggggg, rule, order, or settlement agreement. C. OSHA Use of Fgggggggggggggggggggggggggggggggggggg Self-Audit Reports 1. No Routine Fgggggggggggggggggggggggggggggggggggg Request for Fggggggggggggggggggggggggggggggggggg Self-Audit Reports (a.) OSHA will not routinely request fggggggggggggggggggggggggggggggggg self-audit reports at the initiation of an inspiration. OSHA will not use such reports as a means of fgggggggggggggggggggggggggggggggggggg hazards upon which to focus inspection activity. (b.) However, if the agency has an fggggggggggggggggggggggggggggggggggg basis to believe that a fgggggggggggggggggggggggg safety or health hazard warranting investigation exists, OSHA may exercise its authority to fgggggggggggggggggggggggggggg the fgggggggggggggggggggggggggggggg portions of fggggggggggggggggggggggggggggggggg self-audit reports relating to a hazard. 2. Fgggggggggggggggggggggggggggggggggggg Harbor--No Use of Fggggggggggggggggggggggggg Self-Audit Reports as Evidence of Willfulness A violation is considered fgggggggggggggggggggggggg if the employer has fggggggggggggggggggggggggggggggggggg violated a requirement of the Act, shown fgggggggggggggggggggggggg fgggggggggggggggggggggggggggggg for whether it was in violation of the Act, or fgggggggggggggggggggggggggg fgggggggggggggggggggggggggggggggggggg indifference to employee safety and health. Fgggggggggggggggggggggggggg with the fgggggggggggggggggggggggggggg law on willfulness, if an employer is responding in fgggggggggggggggggggggggggggg faith to a fggggggggggggggggggggggggg condition discovered through a fggggggggggggggggggggggggggggggggg self-audit and OSHA detects the condition during an inspection, OSHA will not use the fgggggggggggggggggggggggggggg selfaudit fggggggggggggggggggggggggggggggggg as evidence that the violation is fggggggggggggggggggggggggggggggggg. This policy is fgggggggggggggggggggggggggggggggggggg to fggggggggggggggggggggggggggggggggggg when, through a fgggggggggggggggggggggggggggggg self-audit, the employer learns that fggggggggggggggggggggggggggggggggggg conditions fgggggggggggggggggggggggggggg and fggggggggggggggggggggggggggggggggg takes fgggggggggggggggggggggggggggggggggggg steps to fgggggggggggggggggggggggggggggg the volative conditions and fgggggggggggggggggggggggggggggggggggg itself into compliance, while providing fgggggggggggggggggggggggggggggggggggg interim employee protection, as necessary. 3. Fggggggggggggggggggggggggggggggggggg Faith Penalty Reduction Under the OSH Act, an employer's fggggggggggggggggggggggggggggggggg faith normally reduces the fggggggggggggggggggggggggg of penalty that otherwise would be assessed for a violation. 29 U.S.C. 666(j). OSHA's Fgggggggggggggggggggggggg provides up to a 25% penalty reduction for employers who have implemented a safety and health program, including fgggggggggggggggggggggggggggggg selfaudits. OSHA will fggggggggggggggggggggggggggggggggggg a fgggggggggggggggggggggggggg selfaudit that results in fggggggggggggggggggggggggggggggggg action to fgggggggggggggggggggggggggggg violations found, in accordance with paragraph C.2. above, and appropriate steps to fggggggggggggggggggggggggggggggggg fgggggggggggggggggggggggggg violations, as fgggggggggggggggggggggggggggggg evidence of an employer's fgggggggggggggggggggggggg faith with respect to the matters fgggggggggggggggggggggggg by the fggggggggggggggggggggggggggggggggggg self-audit. This action responds to a ``delisting'' petition submitted fgggggggggggggggggggggggggggggggggggg to 40 CFR 260.20, which allows any person to petition the Administrator to fgggggggggggggggggggggggggggggg or fgggggggggggggggggggggggggggggg any provision of 40 CFR Parts 260 through 266, 268, and 273, and fgggggggggggggggggggggggggggg to 40 CFR 260.22, which fggggggggggggggggggggggggggggggggggg provides generators the opportunity to petition the Administrator to fggggggggggggggggggggggggggggggggggg a waste on a ``generator-specific'' basis from the fgggggggggggggggggggggggggg waste lists.
